| Senior Member | Okay, i'm not even sure if this is in the right forum, but here it goes. About a month back I was entertaining the idea of moving to Germany with my girlfriend for 7 months while she finished University, however, we have decided against that, and that it would be in our best interest for her to go back, finish school, and return in June of 08. (If I repeat anything from the first paragraph bare with me....I copy and pasted my posting from another forum who's advice I respect) Registered: Feb 2005 Location: Posts: 3194 Moving to the USA I'm looking for anyone who has either immigrated to the United States as a Permenant Resident/Legal Citizen, or someone who has personally gone through this experience with a spouse or significant other. My situation: Girfriend is a German Citizen. She has been living in the United States the past two years on a work Visa, however, she will be returning to Germany from Dec 07-Jun 08 to finish University. As soon as she graduates from University our plans are for her to move back to the United States. We plan on eventually wedding, however, the engagement visa is not for us, because it's definately not going to be happening within 90 days of June 08. She is getting very worried that we may run into problems, but I keep trying to re-assure her that with her background (Speaks/Reads/Writes perfect English, has two years work experience in the US, full time employment in Germany prior to coming to the US, and a soon to be Bachelors degree) that there isn't much she should worry about. I would think her background makes her the ideal candidate for eventual citizenship. However, i've never dealt with anything like this before so I dont know. So if there is anyone from the boards who has any experience with this i'd REALLY like to talk with you. I don't know how long the process will take, so we figure we will start as early as possible in case there are any unforseen problems. Thanks |

| Senior Member | As far as I know, you have to get married and then you file petition for alien relative I think it's I-130 with I-485 for adjustment of status (aka green card). Now, you can marry in Germany and you file (but that can take a while and she won't be able to come to the States as a visitor) or you can marry in the States after she comes on fiancee visa (I think it's K-1, form I-129) If she comes on fiancee visa you got 90 days to marry, BUT you don't have to, you can file it again next time if you don't get married. | Old Skool | Not to discourage you, but the situation is more complicated then you might believe, administratively that is. Anyway, I have done it. My wife is EU, we married in Denmark and did all of the filing in Germany, where we lived. We are now both here in the U.S.A. We have done all of the paperwork, so if you got questions I got answers.
