Default e-2 investors visa and flight training?

i was wondering if anyone knew if the TSA would grant eligiblity for flight training to a german citizen with an E-2 investors visa and american SS#, that also has been living here in the states for the past 10 years and has the green card in process. i heard M-1 and F-1 are the appropriate student visas for flight training but since germany is under the visa waiver program i was curious to know if the TSA would let it slide. any help would be very appreciated.

I doubt it, it is not a 'student' visa. I get mine through F-1 status. altough you are waived with a visa when coming here, it is only for touristic reasons. Also E-2 is a secondary to E-1 I believe too.

The whole thing is a mess.

All TSA do is ask immigration if someone is legally in the country for flight training.

M1 and J1 visas are only permitted to be issued to somone who is here only for flight training and is enrolled in a full time course.

So what about somone who wants to do three or four flying lessons during their two week holiday?

Well, technically you can study on the waiver (or any visa, including E-2) if you do less than 18 hours per week of study.

But there is no way to tell TSA what kind of rate your student will move through the course, so they give immigration no information as to if a visa is required, and so immigration won't give the 'right answer'.

And then your 16 year old foreign kid is deported for being a terrorist.
