I vaguely remember a few years ago an instructor suggesting I call up someone an hour before the flight because one of our radios would not go past 130.00 (which we needed for a bay tour). I feel weird not knowing this, but who was I supposed to call? The reason I ask because a student pilot friend of mine is saying he can go through the mode C vail without a transponder as long as he gets approval from SJC class charlie. I read 91.215 and there is no mention of calling flight watch or anyone for said clearance.

91.131.C says that "unless otherwise authorized" you need radio. I am pretty sure you can call them to get permission, I have done it with an INOP transponder. Call and ask.
