Hello all,

Can anyone offer clarification for me on this......

91.213(2)(i)
Part of the VFR-day type certification instruments and equipment prescribed in the applicable airworthiness regulations under which the a/c was type certified.

My question is where can I find this if I have a piece of inop. equip?

What they're effectively incorporating by reference is Part 23, if the aircraft is a Part 23 airplane. So whatever was in Part 23 for VFR day type certification when the aircraft was certified is required equipment.

That's the 99.999% correct answer. Which is one of the problems since many of the light airplane that we are flying today were certified under the older CAR (before the FAA Act) and even Part 23 of the FAR changes, so technically you'd have to locate a copy of the certification regs as they existed when the airplane was certified.

Fortunately, the bulk of the information you need to have is covered by a combination of the Type Certificate Data Sheet, the limitations in the approved flight manual (or what passes for it in older aircraft), and equipment lists that indicate what equipment is "Required." But I wouldn't be surprised to hear that there are some airplanes out there that slip though the cracks on having the information easily available.

BTW, Sidious, I want to compliment you on the question. Looking and trying to understand 91.213 is so far superior to the ridiculous memorization of 91.205 that goes on so much.

Yes. My understanding is that regulations in place at the time of certification comprise part of the type certificate. The Type Certificate Data Sheet is, itself, not the type certificate, but merely part of it.
